The products in the confidential records store are not legally binding offers; they are presented as part of an online catalogue without obligation. By placing an order, the customer enters into a binding contractual agreement to purchase the goods. The purchase contract becomes effective with the delivery of the goods.
If goods are in stock, they will be dispatched usually within 2 working days for orders to be delivered to an address within Germany. For all other countries, all goods, if in stock, are dispatched within 4 to 15 working days.
4.1 Payment method Customers are asked to provide their credit cards details (Mastercard, Visa or American Express) together with their order. The invoice will be sent to the customer either with the goods or separately.
4.2 Payment conditions Delivery is carried out for the currently valid gross price (net price plus statutory value added tax).
4.3 Shipping costs The actual shipping costs depend on the chosen shipping method and the country of destination (country in which the buyer resides). The total sum payable for shipping shall be understood as net price plus statutory value added tax. The shipping fees are listed in detail in the red dot design store and are displayed to the customer at the time of ordering.
4.3.1 Shipping costs within Germany Shipping costs on orders with a total gross price of EUR 199,99 or less shall be paid by the buyer.
Orders with a total gross price of EUR 200.00 or more to be sent by “Standard Delivery” to destinations within Germany are free of shipping charge.
4.3.2 Shipping costs outside Germany (zones 1–6) The shipping costs depend on the chosen shipping method (Standard or Express International), the country of destination (zones 1–6) and the weight. Outside Germany the shipping charge for orders over EUR 20.00 is reduced by EUR 7.00.

Article 5 Revocation instruction
5.1 Right of revocation
You are entitled to revoke your declaration to conclude a sales contract without the need to state a reason within a period of 14 days in textual form (e.g. by letter, fax, e-mail) or – if the goods were delivered to you before the revocation period expired – by returning the goods.
The revocation period commences with the receipt of this revocation instruction in textual form, but not prior to the buyer receiving the goods, nor prior to us fulfilling our legal obligation to provide information according to German Civil Code Art. 246 § 2 in combination with § 1 (1) and (2) (EGBGB), nor us fulfilling our obligation according to § 312e (1) sentence 1 (BGB) in combination with Art. 246 § 3 (EGBGB). The time limit shall be deemed to be observed by the timely despatch of the declaration of revocation or the return shipment.

5.2 Costs of the return shipment
The customers have to bear the costs of the return consignment of the goods (when exercising the right of withdrawal), if the goods delivered are correspondent to the goods ordered and if the value of the returned item does not exceed 40,00 € or -in case of a higher price- if the customer has not yet provided the counter performance or a partial payment if contracted. Otherwise the return consignment of the goods will be at no charge for our customers.
5.3 Consequences of revocation
In the event of a valid revocation, the services received by either party shall be returned and any benefits (e.g. interests) that may have been accrued shall be reimbursed. If you are unable to return the received goods either in total or in part or only in deteriorated condition, you shall compensate for the loss in value, if applicable. This shall not apply in the event that the deterioration of the surrendered goods is due to the inspection of the goods – as it would have been possible in a shop. You may, moreover, avoid such liability of indemnification if you refrain from using the goods as if you owned them and further refrain from any action that would diminish the value of the goods. Goods capable of being sent by parcel shall be sent back at our risk. You shall bear the costs of the return shipment if the goods delivered are as ordered and the value of the returned product does not exceed EUR 40.00 or if, in case of a higher value of the product, you have at the time of the revocation not performed the return service or the agreed partial payment. All reimbursement obligations must be fulfilled within 30 days of the declaration of revocation. This period commences for you on the day of filing your declaration of revocation or returning the goods, and for us on the day of receiving the goods.

Article 6 Reservation of proprietary right For all deliveries we reserve the unlimited proprietary rights until the customer has completely fulfilled all payment liabilities.
Article 7 Warranty and liability
7.1 Complaints
Product damage and other complaints shall be asserted in writing (letter, fax, e-mail) and forwarded without delay to Confidential Records Ltd.
7.2 Rectification or replacement
If applicable, rectification or replacement claims must be invoked within the statutory warranty period.
7.3 Withdrawal from contract / Reduction of price
In as far as we are unwilling or unable to rectify or replace the goods or this fails for other reasons, then the customer is entitled to choose either to withdraw from the contract or demand an appropriate reduction of the purchase price (decrease).
7.4 Further claims
Further claims of the customer, namely claims for damages for delayed or omitted delivery, are excluded. This does not apply if the cause for the loss is based on intent or gross negligence on our part or if injury of life, body or health is involved.
In case Confidential Records Ltd negligently breaches an essential contractual obligation, the liability for material damage shall be limited to typically accrued damage.
Article 8 Offset, retention
The right to offset shall only accrue to the customer if the counterclaims have been legally ascertained or are undisputed by Confidential Records Ltd Store. In addition, the customer shall only be entitled to exercise a right of retention if the counterclaim is based upon the same contractual relationship.
Article 9 Final provisions
9.1 Severability clause
Should any provision of this agreement be found to be or become partially or wholly invalid, the validity of the remaining provisions hereof shall in no way be affected. The invalid provision shall be replaced by a provision which within the bounds of legal possibility comes closest to that which the parties would have intended.
9.2 Place of fulfilment, court of jurisdiction and applicable law
The place of fulfilment and court of jurisdiction is Berlin, Germany. German law shall apply exclusively.
